1. Acceptance of Terms

By accessing or using BetterGate ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. Your continued use of BetterGate constitutes acceptance of these terms and any future modifications.

2. Description of Service

BetterGate is a music promotion tool that enables artists and creators to:

• Create gates (Download Unlock and MusicBridgeLink) to promote music
• Upload and host music files for fan distribution
• Generate smart links that aggregate streaming platform links
• Track analytics including visits, downloads, clicks, and geographic data
• Require fan engagement actions before unlocking content

3. User Accounts

To use BetterGate, you must create an account using either an email and password or Google OAuth authentication. You must be at least 13 years of age to create an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Acceptable Use

You agree not to use BetterGate to:

• Upload, distribute, or share pirated or copyrighted content without authorization
• Distribute spam, malware, or any malicious software
• Upload illegal content or content that violates any applicable laws
• Impersonate others or misrepresent your identity
• Attempt to exploit, hack, or disrupt the Service

You represent that you own or have the necessary rights to all content you upload to BetterGate.

5. Intellectual Property

You retain all ownership rights to content you upload to BetterGate. By uploading content, you grant BetterGate a non-exclusive, worldwide license to host, store, serve, and distribute your content solely for the purpose of operating the Service. This license terminates when you delete your content or account.

6. File Storage

Files uploaded to BetterGate are stored on Cloudflare R2 cloud storage. Files are subject to size limits as determined by the Service. We reserve the right to remove any files that violate these Terms of Service. Deleted accounts will have all associated files permanently removed from our storage systems.

7. Analytics & Data

BetterGate collects and provides analytics data for gate owners, including page visits, download counts, click tracking, and geographic data derived from visitor IP addresses. This data is provided to help you understand your audience and improve your promotion efforts.

8. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms of Service, including but not limited to accounts that upload pirated content, distribute spam, or engage in illegal activities. Users may delete their accounts at any time through their account settings, which will result in permanent removal of all associated data and files.

9. Limitation of Liability

BetterGate is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. In no event shall BetterGate be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting the updated terms on this page. Your continued use of BetterGate after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
